Terms of Service

These terms and conditions (hereinafter referred to as “the T&Cs”) set out the terms between you and the National Health Fund (“NHF” “our”, “us” as the context requires), under which you may access the NHF Quick Prescript application (“Quick Prescript” or “application” as the context requires) and applies to all users of Quick Prescript. Quick Prescript is a platform which enables you to access or augment the delivery of pharmacy services or pharmacy benefits to you and to [retrieve pharmacy records on demand].

How The Terms Apply

Please read these T&C’s together with our Privacy Notice before logging on and using the application. By registering and continuing to use Quick Prescript, you accept, and agree, to be legally bound by all the terms of use contained in this T&C’s, as may be amended from time to time. If you do not agree to the terms of these T&C’s, please do not access and/or use the application or website. We reserve the right to amend the T&C’s at any time without further notice to you but may provide notice if we make major changes.

UPDATES TO QUICK PRESCRIPT

We may, from time to time, make updates to the application and these updates may be automatically updated on your device [if you allow us to push updates to your device]. These updates allow for improved performance, functionality and security of the system. If the updates are not installed, you may not be able to use the application, experience reduced functionality or your sensitive health data may become less secure against external threats.

HOW TO USE QUICK PRESCRIPT

You will need to register using your personal email address or mobile phone number in order to activate the application on your device. [In order to use the intended benefits you must provide your beneficiary number on your NHF card]. You must ensure that the information you provide is complete and accurate. If you download, print, or export any of your personal data stored or accessed via the application, you are responsible for ensuring that such data is held securely and we will not be liable for any associated disclosure of your sensitive or other personal data.

If you use the application for the benefit of a child or someone for whom you care, these T&C’s will remain application to your use and you should ensure that you do not share your password and user name with anyone else, including the person on whose behalf you are accessing the application. You must, to the extent possible bearing in mind the age, mental capacity or other condition of the other person, make that person aware that you are making access on their behalf, the steps taken and the extent of these T&C’s.

SERVICES PROVIDED

The application provides core on application services and otherwise provides a platform for services obtained on or via the NHF website.

Following registration you will be able to upload your prescription to the application and allow the application to find a DrugServ pharmacy or other NHF eligible pharmacy near you to facilitate fulfilment. With the functionality “Ask Your Pharmacist?” you will be re-directed to an NHF customer service portal hosted on the NHF website.

PROHIBITED USES

You may use our services only for lawful purposes. You may not use our application or website in the following manner: –

in any way that breaches any applicable laws or regulations.
in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect.
for the purpose of harming or attempting to harm others in any way.
to send, knowingly receive, upload, download, use or re-use any material which does not comply with our content standards.
to transmit or procure the sending of any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam).
to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.
to falsify disclosures provided to the National Health Fund, its partners, service providers or affiliates.

You also agree: –

not to reproduce, duplicate, copy or re-sell any part of our application in contravention of the provisions of this T&C’s;
not to access without authority, interfere with, damage or disrupt any part of the application, any equipment or network on which the application is stored; any software used in the provision of our site; or any equipment or network or software owned or used by any third party.
not to use the application unless it is downloaded from an approved application marketplace (Google Play Store or Apple App Store).

INTERACTIVE SERVICES

The NHF may from time to time provide interactive services on the application and website, including, without limitation:

Chat rooms; and,
Bulletin boards.

We will do our best to assess any possible risks for users (and in particular, for children) from third parties when they use any interactive service provided on our site, and we will decide in each case whether it is appropriate to use moderation of the relevant service (including what kind of moderation to use) in the light of those risks. However, we are under no obligation to oversee, monitor or moderate any interactive service we provide on our site, and we expressly exclude our liability for any loss or damage arising from the use of any interactive service by a user in contravention of our content standards, whether the service is moderated or not. The use of any of our interactive services by a minor is subject to the consent of his/her parent or guardian. We advise parents who permit their children to use an interactive service that it is important that they communicate with their children about their safety online, as moderation is not foolproof. Minors who are using any interactive service should be made aware of the potential risks to them. Where we do moderate an interactive service, we will normally provide you with a means of contacting the moderator, should a concern or difficulty arise.

DISCLOSURES

Any and all material which you provide/transmit to us via our application and website, including but not limited to statements, instructions or contributions transmitted via our application or website (hereinafter referred to as “disclosures”). You must comply with the spirit of the following standards as well as the letter. The standards apply to each part of any disclosure as well as to its whole.

Disclosures must:

be accurate (where they state facts).
be genuinely held (where they state opinions).

Disclosures must not:

contain any material which is defamatory of any person.
contain any material which is obscene, offensive, hateful or inflammatory.
promote sexually explicit material.
promote violence.
promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age.
infringe any copyright, database right or trade mark of any other person.
be likely to deceive any person.
be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence.
promote any illegal activity.
be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety.
be likely to harass, upset, embarrass, alarm or annoy any other person.
be used to impersonate any person, or to misrepresent your identity or affiliation with any person.
give the impression that they emanate from us, if this is not the case.
advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse.

SUSPENSION AND TERMINATION

We will determine, in our discretion, whether there has been a breach of this T&C’s through your use of this application. When a breach of this T&C’s has occurred, we may take such action as we deem appropriate including, but not limited to, any or all of the following actions: –

Immediate, temporary or permanent withdrawal of your licence/permission to use the application.
Immediate, temporary or permanent removal of any disclosure or material uploaded by you to our site.
Issue of a warning to you.
Legal proceedings against you for reimbursement of all costs on an indemnity basis, including, but not limited to, reasonable administrative and legal costs, resulting from the breach.
Further legal action against you.
Disclosure of such information to law enforcement authorities as we reasonably feel is necessary.
Any other action we deem appropriate.

We exclude liability for our actions taken in response to any breach of this T&C’s. You hereby agree to indemnify us of any cost, action or liability suffered by us or suffered by yourself or a third party as a result of our action, howsoever caused, taken in response to any breach of this T&C’s.

CHANGES TO THESE T&C’S

We may revise these T&C’s at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we make, as they are legally binding on you. Some of the provisions contained in this T&C’s may also be superseded by provisions or notices published elsewhere throughout the application.

GENERAL

These terms together with the polices or notices incorporated by reference represent the NHF’s entire agreement with you on the use of this application. Any delay in enforcing the T&C’s shall not constitute a waiver of any of these terms. The laws of Jamaica will exclusively apply tot hese T&C’s and in the event of a dispute the courts of Jamaica will have exclusive jurisdiction.
